These Terms of Service (“Terms”) govern your access to and use of our website, products, and services (collectively, “Services”). By accessing or using our Services, you agree to comply with and be bound by these Terms.

 

1. Acceptance of Terms

By accessing or using Stage Snapped, you confirm that you have read, understood, and agreed to these Terms, our Privacy Policy and Refund Policy. If you do not agree with these terms, please do not use our Services.

 

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use our Services. By using our Services you represent and warrant that you meet these eligibility requirements.

 

3. Account Registration

To access certain features, you will need to create an account. You agree to:

• Provide accurate and complete information during registration.

• Maintain the security of your account credentials.

 

4. Services Provided

We offer virtual staging solutions for real estate. Our services include, but are not limited to, virtual furniture staging and interior design visualization.

 

5. User Content

 

5.1 You may insert or upload images or other forms of content while using our Services and received output such as images or other forms of content generated and returned by our Services based on the Input. Input and Output are collectively referred to as “Content”. As between the parties and to the extent permitted by applicable law and regulation, you own all of the Content.

 

5.2 You are creating AI Content. Due to the nature of AI learning, your results may not be unique and our Services may generate similar output if the same or similar input and style templates are provided to us by another user. No guarantees are made with respect to content quality and reliability. The prompts made by the user determine the output.  You may need to change the prompts several times to receive the output you desire.  You are charged for each image output you receive.  You are responsible for evaluating the appropriateness of your results for use.

 

6. Prohibited Conduct

You agree not to:

• Use our Service for any illegal or unauthorized purpose.

• Violate any laws in your jurisdiction.

• Infringe upon or violate our intellectual property rights or the intellectual property rights of others.

• Upload or transmit viruses or any other malicious code.

 

7. Payment and Subscription

 

7.1 We may charge for your use of our Services in accordance to the prices on the applicable pricing page and we reserve the right to correct pricing errors or mistakes even if a charge has already been issued to you.

 

7.2 We may carry out promotional activities in the future that may result in a discount on price. Due to the time sensitive and promotional nature of the discount, price matching or refunds for previous purchases are not available.

 

7.3 If you choose a subscription plan you acknowledge that your subscription will automatically renew for recurring subscription periods of the same duration until and unless you affirmatively cancel your subscription by contacting us in writing.

 

7.4 You agree to provide complete and accurate billing information. You authorize Stage Snapped and its affiliates, and third-party payment processor(s), to charge your payment method for any invoiced fees. If your payment cannot be completed, Stage Snapped will suspend your access to the Services until the payment is received. Payments are non-refundable.

 

8. Commercial Usage Rights

Upon subscribing to our plan, you are granted to use the AI-generated photos produced through our Service for commercial purposes. This includes the rights to publish and use these images on listing websites and for promotion media.

 

9. Termination

We reserve the right to suspend or terminate your account and access to our Service at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of our Service, us, or third parties, or for any other reason.

 

10. Disclaimers

Our Service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including, but not limited to, merchantability, fitness for a particular purpose, and non-infringement.

 

11. Limitation of Liability

To the fullest extent permitted by law, Stage Snapped shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use our Service.

• Any unauthorized access to or use of our servers and/or any personal information stored therein.

 

12. Indemnification

You agree to indemnify and hold harmless Stage Snapped and its affiliates, officers, agents, and employees from any claim or demand made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

 

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.

 

14. Changes to Terms

We reserve the right to modify these Terms at any time. Your continued use of our services after such changes constitutes your acceptance of the new Terms.
